Be it enacted by by the Sangguniang Bayan of Asingan, in session assembled, that:
Section 1. Title. — An Ordinance imposing fare rate increase for tricycle plying their route within the territorial jurisdiction of the Municipality of Asingan.
Section 2. The Committee on Public Works, Utilities and Facilities thru public hearing held on January 6, 2011, with the United Federation and Tricycle Operators and Drivers Association, Barangay Captains, Non-government Organization (NGOs) and concerned citizens, and recommended that the increase to be imposed shall be decided by the Sangguniang Bayan Members;
Section 3. The new fare rate shall be as follows:
PhpIO.OO for the first kilometer; and
Additional Phpl .00 for every succeeding kilometer
Section 4. Senior Citizens, students and persons with disability shall be given a discount of twenty percent (20%) of the fare rate from Monday to Sunday.
Section 5. The fare rates shall be posted on a conspicuous place inside the otorized tricycle and within the premises of the terminals of various Tricycle Drivers and Operators Association in the Municipality.
Section 6. Any tricycle driver found violating Sections 3, 4 and 5 of this ordinance shall be subject to the following penalties:
a. FOR THE FIRST OFFENSE, an imprisonment of one (1) month or a fine of Phpl 000.00 or both at the discretion of the court.
b. FOR THE SECOND OFFENSE, an imprisonment of two (2) months or a fine of Phpl ,500.00 or both at the discretion of the court.
c. FOR THE THIRD OFFENSE, an imprisonment of three (3) months or a fine of Php2,OOO.OO or both at the discretion of the court.
Section 7. Any existing ordinance, which is inconsistent with the provision of this Ordinance, is hereby repealed.
Section 8. This ordinance shall take effect after proper posting and/or publication as required by law.
