f. throwing, spilling, scattering or depositing litter on any part of the road, street or any other public place within the city, or upon private property, on their way to their destination;
g. leaving deposit of litter, mud or any foreign matter from moving vehicles; and h. sweeping or depositing accumulated litter into street, waterway, canal, gutter, or to any public place from any building or lot, or from any public or private sidewalk or driveway.
5. Smoking in public places. It shall be unlawful for any person to carry a lighted cigarette or tobacco products, whether or not it is being inhaled or smoked in any public area.
6. Spitting. No person shall carelessly or intentionally eject saliva, phlegm, mucus or other substances from the mouth onto surfaces in any public area, except for designated receptacles.
SECTION 5. FINES AND PENALTIES. Any person, juridical or otherwise, found committing any of the following prohibited/restricted acts shall be penalized, to wit:
1. Jaywalking (pursuant to Article XXV, Item No. 52 of City Ordinance No. 2021-13)
First offense - Fine of Php 500.00
Second offense - Fine of PhP 1,000.00
Third offense -Fine of Php 3,000.00 or imprisonment of not less than 15 days but not more than 6 months, or both at the discretion of the court.
2. Illegal parking (pursuant to City Ordinance No. 2021-13)
Fine of PhP 200.00 - First offense
Second offense - Fine of PhP 300.00
Third and succeeding offenses - Fine of PhP 500.00
3. Illegal vending (pursuant to Section 6 of City Ordinance No. 2003-23) Fine of PhP 1,000.00 or imprisonment of five (5) days or both such fine and imprisonment upon the discretion of the court. imprisonment upon the discretion of the court.
4. Littering (pursuant to City Ordinance No. 2011-08)
a. Any person who violates paragraphs (a) and (b) under Section 4.4 hereof shall be punished with a fine of PhP 100.00 and shall pick-up/clean the litter thrown and/or reparation for damages made, plus damages
For failure to pay the administrative fine, the violator shall be penalized, after conviction, by a fine of One Thousand Pesos (PhP 1,000.00) or imprisonment of three (3) to seven (7) days of arresto menor or both at the discretion of the court.
b. Any person who violates paragraphs (c), (d), and (e) under Section 4.4 hereof shall be punished with a fine of PhP 500.00 and shall pick-up/clean the litter thrown and/or reparation for damages made, plus damages.
For failure to pay the administrative fine, the violator shall be penalized, after conviction, by a fine of One Thousand Pesos (PhP 1,000.00) or imprisonment of three (3) to seven (7) days arresto menor or both at the discretion of the court.
c. Any person who violates paragraph (f) under Section 4.4 hereof shall be punished with a fine of PhP 1,000.00 and/or reparation of damages made, plus damages.
